Terms and Conditions

These Terms and Conditions apply to your access to and use of the Where Next website, Where Next Connector and associated services. By downloading, installing, purchasing or using Where Next Connector, you agree to these terms.

In these terms, Where Next, we, us and our refer to the operator of the Where Next service. You and your refer to the individual or organisation using the website, software or services.

1. Where Next Connector

Where Next Connector is a WordPress plugin that enables compatible website content, including places and events, to be described using Where Next tags and shared with the Where Next app.

The Connector may include free functionality and additional functionality that requires a valid Pro licence.

2. Licence

Subject to these terms, we grant you a limited, non-exclusive, non-transferable and revocable licence to install and use Where Next Connector on the number of websites permitted by your licence.

You may not:

  • Sell, sublicense or redistribute the plugin as your own product
  • Share a paid licence key with an unauthorised person or website
  • Attempt to bypass, disable or interfere with licence validation
  • Use the software in a way that infringes intellectual-property, privacy or other legal rights
  • Reverse engineer or modify protected parts of the software except where applicable law expressly permits it
  • Use the Connector to distribute malicious, misleading or unlawful content

3. Free and Pro functionality

Where Next Connector is distributed as one universal plugin package. Free functionality is available without purchasing a paid plan. Pro functionality becomes available when a valid Pro licence is registered and activated.

A Pro licence may enable features including automatic button placement, display templates, positioning, device targeting, desktop QR codes, click analytics, CSV analytics export and configurable data retention.

4. Purchases and payments

Where Next Connector Pro payments are processed by Freemius, which acts as the merchant of record. Freemius manages checkout, payment processing, applicable sales taxes, subscription administration and licence delivery.

Your purchase may also be subject to the customer terms and privacy information presented by Freemius during checkout.

Prices displayed before checkout may exclude taxes that must be calculated using your billing location. The complete amount payable will be shown before you confirm the purchase.

5. Subscriptions and renewals

Annual Pro licences renew automatically unless automatic renewal is cancelled before the renewal date. Renewal payments use the payment method associated with the subscription.

You can manage or cancel automatic renewal through the Freemius account and subscription tools made available after purchase. Cancelling renewal prevents future renewal charges but does not normally refund a payment that has already been processed.

6. Refunds

Where Next Connector Pro is covered by the refund policy in force at the time of purchase. The current policy provides a 14-day strict money-back guarantee for qualifying unresolved defects.

7. Updates

We may release updates to improve compatibility, security, reliability or functionality. Updates may add, change or remove features where reasonably necessary.

You are responsible for maintaining suitable backups and testing updates in an appropriate environment before applying them to a production website.

8. Support

Support is provided through the channels described on the Where Next support page. We will make reasonable efforts to investigate reported defects but cannot guarantee compatibility with every theme, plugin, hosting configuration or third-party service.

You remain responsible for administering, securing and backing up your WordPress website.

9. Website content and mappings

You are responsible for the accuracy, lawfulness and maintenance of content exposed through Where Next Connector, including names, descriptions, images, prices, dates, locations, links and other mapped information.

You must have the necessary rights and permissions to publish and share that content. Where Next does not acquire ownership of your website content merely because it is processed or shared through the Connector.

10. Analytics and privacy

If Pro click analytics are enabled, the Connector may store button clicks, content identifiers, page URLs, event times, device categories and button modes within your WordPress installation. The feature is designed not to store IP addresses, cookies or complete user-agent strings.

You are responsible for ensuring that your use of the Connector and analytics features is described accurately in your own privacy and cookie information and complies with applicable law.

11. Third-party services

Where Next Connector works with WordPress and may interact with Where Next, Freemius, hosting providers and other third-party services. Those services are controlled by their respective providers and may be subject to separate terms and privacy policies.

We are not responsible for the availability, security, content or operation of third-party products and services.

12. Intellectual property

Where Next Connector, its code, design, documentation, branding and associated materials are owned by or licensed to Where Next and are protected by applicable intellectual-property laws.

These terms do not transfer ownership of the software, branding or associated intellectual property to you.

13. Availability and warranties

We aim to provide a reliable service, but the website, plugin and associated services are supplied on an as-available basis. We do not guarantee that they will always be uninterrupted, error-free or compatible with every configuration.

Nothing in these terms affects warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Where Next will not be liable for indirect or consequential losses, loss of profits, loss of revenue, loss of data, business interruption or damage resulting from third-party products or services.

Where liability cannot lawfully be excluded, our total liability relating to a paid licence will not exceed the amount you paid for that licence during the 12 months immediately preceding the event giving rise to the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot lawfully be excluded.

15. Suspension and termination

We may suspend or terminate access to paid functionality where a licence expires, a payment is reversed, these terms are materially breached or the software or licence is used unlawfully.

On termination, you must stop using functionality that requires an active licence. Any provisions intended to continue after termination, including intellectual-property and liability provisions, will remain in effect.

16. Changes to these terms

We may update these terms to reflect changes to the software, services, business arrangements or applicable law. The revised terms will be published on this page with an updated revision date.

17. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights you may have as a consumer in your country of residence.
